The provisions of this article apply only to Customers who purchase items online from LxryVintage in their capacity as consumers.
The Customer has the right to revoke the agreement within a period of 14 calendar days without giving reasons.
The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, takes physical possession of the good.
To exercise the right of withdrawal, the Customer must inform LxryVintage (, +31641406099, [email protected]) of his decision to withdraw from the contract by an unequivocal statement (e.g. e-mail). The Customer may use the attached model withdrawal form for this purpose, but is not obliged to do so.
To comply with the withdrawal period, the Customer must send his communication concerning his exercise of the right of withdrawal before the withdrawal period has expired.
The Customer must return or hand over the goods to LxryVintage, Konging Boudewijnlaan 20A, without delay, but in any event no later than 14 calendar days from the day on which he communicates his decision to withdraw to LxryVintage. The Customer is on time if he returns the goods before the period of 14 calendar days has expired.
The direct cost of returning the goods shall be borne by the Customer.
If the returned item is somehow diminished in value, LxryVintage reserves the right to hold the Customer liable and claim compensation for any diminution in the value of the goods resulting from the Customer’s use of the goods beyond what is necessary to establish the nature, characteristics and functioning of the goods.
If the articles are no longer in their original packaging and/or if accessories are missing, a case-by-case examination will be made to determine whether the right of withdrawal can be invoked.
The right of withdrawal lapses in the case of articles designed or manufactured with specific requirements of the Customer, and which therefore deviate from a standard product, as well as in the following cases on the basis of the grounds for exceptions in Article VI. 53 WER.
1° service contracts after full performance of the service if the performance has begun with the express prior consent of the consumer, and provided that the consumer has acknowledged that he loses his right of withdrawal as soon as the company has fully performed the contract;
2° the supply or provision of goods or services whose price is subject to fluctuations in the financial market over which the company has no influence and which may occur within the withdrawal period
may occur;
3° the delivery of goods made to the consumer’s specifications, or which are clearly intended for a specific person;
4° the delivery of goods that spoil quickly or have a limited shelf life;
5° the delivery of sealed goods that are not suitable to be returned for reasons of health protection or hygiene and whose seal has been broken after delivery;
6° the delivery of goods which, after delivery, are by their nature irrevocably mixed with other products;
7° the delivery of alcoholic beverages whose price is agreed upon at the conclusion of the sales contract, but whose delivery can only take place after 30 days, and whose actual value depends on fluctuations in the market over which the company has no control
8° contracts in which the consumer has specifically requested the company to visit him in order to carry out urgent repairs or maintenance there; however, when, during such a
such visit provides additional services not expressly requested by the consumer, or supplies goods other than spare parts necessarily used to carry out the maintenance or
repairs, the right of withdrawal shall apply to those additional services or goods;
9° the delivery of sealed audio and sealed video recordings and sealed computer software whose seal has been broken after delivery;

10° the delivery of newspapers, periodicals or magazines, with the exception of contracts for a subscription to such publications;

11° contracts concluded at a public auction;

12° the provision of accommodation other than for residential purposes, carriage of goods, car rental services, catering and services relating to leisure activities, if the contracts stipulate

provide for a specific date or period of performance;

13° the supply of digital content not supplied on a tangible medium, if the performance has begun with the consumer’s express prior consent and provided that the consumer has

acknowledged that he thereby loses his right of withdrawal;

14° contracts for betting and lottery services.

If the Customer withdraws from the agreement, LxryVintage shall refund to the Customer all payments received to date from the Customer, with respect to the returned item, within a maximum of 14 calendar days after LxryVintage has been informed of the Customer’s decision to withdraw from the agreement. For sales agreements, LxryVintage will wait to refund until it has received all the goods back.

Any additional costs resulting from the Customer’s choice of a mode of delivery other than the cheapest standard delivery offered by LxryVintage will not be refunded.

LxryVintage will refund the Customer by bank transfer on account unless mutually agreed otherwise. Under no circumstances will any fees be charged for this refund.
